Emmanuel was stopped for no seat belt and asked to step out of the vehicle due to no driver’s license. As he stood up a green leafy substance fell from his lap. More of the same was found on his person as well as “kush” incense. The substance was sent to the Houston Medical Examiners Lab to be analyzed and found to be positive for the compound 1-(5-fluoropentyl)-3-(1-naphthoyl)indole – a cannaboid receptor under penal group 2A – and positive for synthetic marijuana. The officer testified he believed it to be a usable amount of synthetic marijuana.
