Matt & his wife were having problems with their marriage. Matt locked the bedroom door, insisting they talk, but both were too angry and a violent argument erupted in which each caused significant, visible injuries to the other, she tried to climb out a window, furniture was overturned, and items were smashed – including her cell phone after she threatened to call police. Matt insisted he smashed the phone to make her stay and talk – that she had told him she had already called police. Although his wife never verified this to police, it was our main line of defense. Matt had a good job as a Project Manager and was in the Navy Reserves. Not wanting to risk losing a trial, he was prepared to do jail time, although not guilty, since we could seal it later. We did not give up however and continued working with the evidence and arguing our side skillfully to the State and on the day Matt was to do jail time we won our Dismissal.

Client was a documented gang member. After he and his girlfriend got into a physical fight over suspected infidelity Gang Task Force officers arrived to find her covered in dirt. She told police defendant had beat her up and that she was barely able to call 911 but he grabbed the phone and hung up. Police interviewed no witnesses although one was there. We used this witness, Facebook and text messages, photo evidence and our Discovery Motion and were able to prove a 3rd party interfered with the 911 call as she had drugs in her possession and a warrant out for her.

Spencer grabbed the phone out of his girlfriend’s hand after she called 911 during an altercation. Just before the recording ended she told the operator he was grabbing the phone. To win this we proved State did not have strong enough evidence defendant was aware his girlfriend was calling 911 and showed her inconsistent statements made to the 911 operator during the call, which called into question her credibility.

Lawrence was a NASA engineer who trained astronauts in Mission Control. Subject to background checks and security clearance, as clean a record as possible was one of his top priorities. Although legal separation papers had been filed, Lawrence was still living with his wife at th time of this unfortunate argument during which he jerked the phone out of her hand when she tried calling police. The police ultimately were called and as usual misconstrued the whole situation, putting words in our client’s mouth – and in the police report – that he never said.

Our client had an argument with his pregnant wife. Police took photos of the bruises on her arm, leg and forehead which, our client maintained, were accidental. Our client prevented his daughter from calling the police, who later videotaped the daughter’s statement. Mr. Haggard was able to get both charges dismissed by his first court appearance.
