INJURY TO ELDERLY PERSON
Case No. 1419423 – Jeffrey L.
DISMISSED on NOTICE OF INSANITY DEFENSE August 14, 2014
Jeff had a severe psychotic episode with heavy religious overtones after experiencing extreme sleep, food and liquids deprivation. He had quit his job and was focusing intensely on how to start his own business, viewing videos and studying online. In a bizarre display, he believed the family was in spiritual danger and began pulling members into the bathtub with him for safety and also to baptize them, even including the family cat. When he pulled his elderly mother into the tub with him she sustained bruising and soreness. Unfortunately – but typically – he was charged after his wife called 911 only to obtain medical and mental help for him. Jeff had a similar psychotic break involving evangelizing the inmate population while in custody. Major factors in our defense included that his episode was more psychotic than criminal, that he was not being violent or aggressive toward his mother, and that the fear he inspired was for his own well-being, not for hers. We used extensive records and documentation of psychotic-like events of the weeks leading up to the subject psychotic break as well as psychiatric reports in arguing our case. We were preparing for Trial but got the case dismissed upon notice of our Insanity Defense.
