Mike had just graduated with good grades from automotive school, had a great job lined up and a lot to lose when police observed him enter a hotel room and come out a few moments later. They approached him – legally – on an expired sticker then fired a barrage of confusing questions at him, asking if he had anything illegal on him and threatening to search his car based on his “extreme nervousness” and the high drug crime area. After this intimidation Mike pulled a heroin syringe out of his pocket. Those inside the hotel room were also arrested on heroin and crack charges. We fought this case on the illegal search tactics and won it after intense and skillful arguing of our Jackson v. Denno Motion to Determine Admissibility of Statements.
